While the entire “wish-list” of expected benefits from nanotechnology has received little scrutiny in the U.S. with regard to issues of social justice, ethics specialists and social scientists are beginning to focus on the responsible conduct of actual nano research and development (R&D) in government, commercial, and academic institutions. In view of the current rush to commercialization, the rush by universities to “get aboard,” and the importance of public trust, it is essential to investigate strategies to promote responsible conduct in (...) the nano area. As this paper discusses, public engagement is one strategy; another is the formulation and implementation of standards of care that are the outcome of inclusive, deliberative processes. (shrink)

A summary of the career of a Russian engineer who practiced a century ago in western Europe, as well as in Russia, provides an example of how ethical standards can influence practice across national boundaries. An examination of his career and his conception of engineering, of the evolution of engineering standards and codes, and of the process of formulating codes in particular instances explains how international standards can shape practice in an international context.

The aim was to learn about responsible management in private sector nano enterprises by telephone conversations with lead technologists and managers in companies in the US Midwest. The conversations took place between January and March of 2011. The marked increase starting in 2008 of prescriptive documents such as guidelines, codes of responsibility, and best practices in NanoEthicsBank offered an entry point for initiating the conversations. Had respondents noticed these documents and did they find them useful? Follow-up questions asked about the (...) full life cycle of their products. The responses from 22 of the 25 organizations selected are categorized in 5 groups according to how they described their nano materials/business. A conception of responsible management in organizations is provided to underpin the analysis of the responses. This conception features virtues of concern, care, and foresight implied by a fundamental moral obligation. In the analysis, definitions from the Organization for Economic Cooperation and Development (OECD) and the International Standards Organization (ISO) are used as a basis of comparison in assessing respondents’ claims. Two important gaps are identified. One gap is between actual practices and the prescriptive use of the conception of responsible management in organizations. The other gap is between the actual use of nano terminology and OECD definitions. (shrink)

Simone Weil's Leçons de Philosophie are derived from a course she taught at the lyce;e for girls at Roanne in 1933-4. Anne Reynaud-Gue;rithault was a pupil in the class; her notes are not a verbatim record but are a very full and, as far as one can judge, faithful rendering, often catching the unmistakable tone of Simone Weil's voice as well as the force and the directness of her thought. The lectures form a good general introduction to philosophy, (...) ranging widely over problems about perception, mind, language, reasoning and problems in moral and political philosophy too. Her method of presentation is a characteristic combination of abstract argument, personal experience and literary or historical reference. Peter Winch points out in his introduction to the book some of the more systematic connections in her philosophical work (and between this philosophical work and her other concerns), and makes a number of suggestive comparisons between Simone Weil and Wittgenstein. The translation is by Hugh Price from the Plon edition of 1959. Es ist in der Literatur weithin bekannt, dass im Gesundheitswesen auf unterschiedlichen Ebenen Allokationsentscheidungen getroffen werden. Während es auf der Makroebene um gesellschaftlich-politische Strukturfragen geht, stehen die Akteure der Mikroebene vor der Aufgabe, begrenzte Ressourcen in einer Organisation sinnvoll einzusetzen. In den ethischen Analysen der Mikro-Allokationsebene werden zumeist Entscheidungen der Healthcare Professionals thematisiert, weil sie eine unmittelbare Auswirkung auf die konkreten Patienten haben. Weniger in den Blick geraten Allokationen des Managements, welche die Rahmenbedingungen für Ressourcenzuteilungen beim Patienten betreffen. Hierbei (...) geht es nicht bloß um den Einsatz von Sachmitteln (z. B. Medikamenten- oder Gerätebudgets), sondern auch um den Personaleinsatz. Das Personalmanagement ist damit in wichtige Allokationsentscheidungen eingebunden und trägt eine dreifache Verantwortung: für die Gesundheit der Patienten, der Mitarbeiter und der Organisation. Der vorliegende Beitrag geht der Frage nach, welche Aspekte der Allokationsethik aus der Sicht des Personalmanagements in einem Krankenhaus zu bedenken sind, um der dreifachen Verantwortung gerecht zu werden. Dadurch zeigt sich, dass Allokationsethik in einem Krankenhaus nicht adäquat erfasst werden kann, ohne sich mit dem Personalmanagement zu beschäftigen, da das Personal die wertvollste Ressource ist, die es in einem Krankenhaus zu allozieren gilt. In der Debatte um die embryonale Stammzellenforschung führen die Verfechter der Würde des Embryos gerne eine Gemeinsamkeit von Embryonen und reversibel Komatösen an: Beide sind bloß potentiell Personen. Wenn aber Komatösen fraglos personale Würde zukommt, weshalb sollte man sie Embryonen absprechen? In ihrem AufsatzIn dubio pro embryone kombinieren G. Damschen und D. Schönecker diese Analogie mit einem Vorsichtsargument: Weil die Analogie zumindest gute Gründe für die Annahme biete, Embryonen komme eine menschliche Würde zu, sei angesichts der Schwere des möglichen (...) Unrechts die embryonale Stammzellenforschung nicht zu verantworten. Im Folgenden möchte ich darlegen, weshalb die Analogie nicht ausreicht, um ein solches Vorsichtsargument zu etablieren. In einem ersten Schritt soll gezeigt werden, wie man der Analogie begegnen kann, weshalb das entsprechende Argument also nicht zwingend ist. Um ein Vorsichtsargument zu begründen, würde es allerdings genügen, wenn die Analogie „hinlänglich plausible“ Gründe zugunsten der Würde von Embryonen liefert. In einem zweiten Schritt soll daher – aufbauend auf allgemeinen Überlegungen zum Vorsichtsargument – dargelegt werden, dass die Analogie selbst unter dieser Annahme nicht überzeugen kann. (shrink)

Ein Argument gegen die ärztliche Beihilfe zum Suizid lautet, Patienten könnten sich um Suizidassistenz bemühen, weil sie sich als Belastung empfinden. Dabei wird die Selbstbestimmtheit eines so motivierten Todeswunsches in Frage gestellt. Ist dieses Argument überzeugungskräftig? Empirische Daten zeigen, dass die ärztliche Beihilfe zum Suizid auf der Grundlage dieses Motivs den ethischen Prinzipien der Sorge um das Patientenwohl und des Respekts vor der Autonomie des Patienten nicht widersprechen muss. Denn das Empfinden, anderen zur Last zu fallen, kann trotz adäquater (...) palliativmedizinischer Betreuung wesentlich zu einem Leidensdruck am Lebensende beitragen. Zudem ist dieses Motiv eng verknüpft mit der Sorge um das Wohl der Angehörigen, die einer erheblichen Belastungssituation ausgesetzt sein können. Da aber das Wohlergehen der Familie zu den elementaren Werten von schwerstkranken Patienten am Lebensende gehört, kann der Wunsch nach ärztlicher Beihilfe zum Suizid auch auf der Basis dieses Motivs Ausdruck eines selbstbestimmten Patientenwillens sein. Andererseits korreliert das Empfinden, anderen zur Last zu fallen, mit einer depressiven Verstimmung. Dieser Zusammenhang ist deshalb relevant, da bei depressiven Störungen eine Einschränkung der Selbstbestimmungsfähigkeit vorliegen kann. Vor diesem Hintergrund sind Zweifel an der Selbstbestimmtheit eines so motivierten Sterbewunsches durchaus begründet. Aufgrund des bestehenden Wissensdefizits bei der Feststellung der Selbstbestimmungsfähigkeit ist die Mitwirkung des Arztes bei einem so motivierten Todeswunsch daher ethisch fragwürdig. (shrink)

Der Aufsatz analysiert den Konnex zwischen Individualisierter Medizin und der Forderung nach mehr gesundheitlicher Eigenverantwortung, der oft als plausibel angenommen wird, wenn der Individualisierten Medizin das Potential zugesprochen wird, das solidarisch finanzierte Gesundheitssystem in Deutschland zu transformieren. Ausgehend von einer logischen Rekonstruktion des Verantwortungsbegriffs, die dessen Operationalisierbarkeit unter anderem an Sanktionsvollmachten der jeweiligen Verantwortungsinstanz bindet, und basierend auf einem terminologisch präzisierten Verständnis von Individualisierter Medizin wird folgende These entwickelt: Die Annahme, im Rahmen Individualisierter Medizin sei eine verlässliche Prädiktion anlagebedingter und (...) zugleich lebensstilabhängiger Erkrankungsrisiken möglich, verpflichtet logisch nicht zur Übernahme der Forderung, Lebensstile mit negativem Einfluss auf persönliche Erkrankungsrisiken seien zu sanktionieren. Weil die Forderung nach mehr gesundheitlicher Eigenverantwortung aus dem Programm der Individualisierten Medizin logisch nicht ohne Hinzunahme normativer Prinzipien abzuleiten ist, kann man dieses Programm selbst gut heißen, ohne sich die politische Forderung nach einem Umbau des solidarisch finanzierten Gesundheitssystems unter dem Vorzeichen gesundheitlicher Eigenverantwortung zu eigen machen zu müssen. Zusammenfassung: Fehlinterpretierte Dokumente und ignorierte physikalische Fakten: Die Geschichte von,Hitlers Atombombe‘ muss korrigiert werden. Warum haben die deutschen Physiker während des Zweiten Weltkriegs keine Atombombe entwickelt? Seit mehr als 25 Jahren sind sich die Historiker einig, dass die deutschen Physiker wussten, wie eine Atombombe gebaut werden muss, dass aber ein Programm wie das amerikanische Manhattan‐Projekt zu ihrer Realisierung in Deutschland, erst recht während des Krieges, unmöglich war. Eine genaue Analyse aller erhaltenen Original‐Dokumente über die Arbeit an der Atombombe während des,Dritten (...) Reichs‘ zeigt jedoch erhebliche Fehler der Autoren durch unvollständige Analyse der Dokumente, falsches Verständnis naturwissenschaftlicher Erläuterungen und Ignorieren physikalischer Fakten. Es wird nachgewiesen, dass die deutschen Physiker bis zum Ende des Krieges nicht bemerkt hatten, dass eine Atombombe nur mit schnellen Neutronen realisiert werden kann. Nur Heisenberg hatte das richtige Prinzip spät erkannt, es aber nicht eindeutig kommuniziert und auch in keiner Weise physikalisch vertieft. Die physikalisch korrekte Interpretation der Dokumente zeigt, dass die deutschen Physiker während des Krieges erfolglos versuchten, einen Reaktor zu entwickeln, der auch eine Voraussetzung für den Bau einer Plutonium‐Bombe gewesen wäre. Aber sie wussten nicht, wie eine Bombe realisiert werden kann, weil sie nie an einer realistischen Theorie der Atombombe gearbeitet hatten. Summary: Misinterpreted Documents and Ignored Physical Facts: The History of ‘Hitler's Atomic Bomb’ needs to be corrected. Why have the German physicists not developed an atomic bomb during World War II? For more than 25 years, the historians agree that they knew how to build the bomb, but that a bomb‐development programme of the size of the US‐Manhattan‐Project would not have been possible in wartime Germany. A detailed analysis of all preserved documents on the German atomic bomb research during the ‘Third Reich’, however, reveals considerable mistakes by the authors due to incomplete analysis of documents, misinterpretations of scientific explanations and ignoring of physical facts. It is shown that until the end of the war the German physicists did not know that an atomic bomb can only be made with fast neutrons, except Heisenberg, who, however, discovered it rather late, did not communicate it clearly and did not study any bomb physics. The physically correct interpretation of the documents reveals that the German physicists worked unsuccessfully on a reactor, which would have been a prerequisite for a plutonium bomb. But they did not know how to build a bomb because they never worked on a realistic bomb theory. (shrink)

Bei der „terminalen Sedierung“ wird ein unheilbar kranker und schwer leidender Patient für den Rest seines Lebens in ein tiefes Koma versetzt. Das hierzu verwendete Morphin bzw. Midazolam kann lebensverkürzend wirken. Ist dies also eine Maßnahme, die das Leben des Patienten beendet, auf seinen Wunsch hin oder nicht? Gewöhnlich wird diese Frage mit nein beantwortet, wenn die lebensverkürzende Wirkung nur vorhersehbar, aber nicht beabsichtigt ist. Allerdings ist der Zugang der Menschen auch zu ihren eigenen Intentionen fallibel, so dass sogar ihre (...) Selbstangaben in komplexen Fällen nicht sehr zuverlässig sind. Wenn ein Arzt sagt, dass er „beabsichtigt“, das Leben eines Patienten zu verkürzen, meint er damit möglicherweise nur, dass dieses vorhersehbare Ergebnis ein erwünschtes ist. Diese Art der Einschätzung kann nicht als solche moralisch diskreditiert werden, weil sie bei anderen allgemein akzeptierten Entscheidungen unvermeidlich ist, z. B. von einer „vergeblichen“ Behandlung Abstand zu nehmen. Legitimerweise können wir von einem Fachmann erwarten, dass er begründet handelt. Deshalb sollte unsere Klassifikation von ärztlichem Handeln als „terminale Sedierung“ oder „Beendigung des Lebens des Patienten“ nicht von den Intentionen des Arztes abhängen, sondern von den in dieser speziellen Krankheitsphase bei diesem speziellen Patienten verwendeten Dosierungen. Das Potenzialitätsargument (PA) ist das wohl wichtigste Argument der Gegner der verbrauchenden Embryonenforschung und des Schwangerschaftsabbruchs. Weil schon der frühe Embryo eine potenzielle Person sei, so das Argument, besitze er bereits den moralischen Status einer Person. Mit der Möglichkeit, aus differenzierten somatischen Zellen „ethisch unproblematische“ induzierte pluripotente Stammzellen (iPS-Zellen) zu gewinnen, schien diese PA-Problematik zumindest für die Forschung umgangen. Indessen zeigen neuere wissenschaftliche Erkenntnisse, dass auch aus pluripotenten Zellen neue Organismen erwachsen können. Der Beitrag argumentiert dafür, dass nach der (...) Logik von PA nicht nur iPS-Zellen, sondern auch die somatischen Zellen, aus denen diese entstehen, als potenzielle Personen mit Würde und Lebensrecht anzusehen wären. Aufgrund dieser Implikationen ist PA auch nicht als Argument für ein Lebensrecht von Embryonen geeignet. (shrink)
